Terms of Service

Terms of Service — Custom Digital Illustration & Character Design ServiceBy requesting a commission from me, you confirm that you have read, understood, and agreed to these Terms of Service.1. Description of ServiceI offer custom digital illustration and character design services based on the information, references, and requests provided by the client.The final artwork will be delivered as a digital file only. No physical product will be shipped unless explicitly agreed upon.2. Request and Approval ProcessTo request a commission, you must provide clear information about your desired artwork, including references, character details, colors, style preferences, pose ideas, intended use, and any other important information.After reviewing your request, I will decide whether I am the right fit for the project. If I am able to take it on, I will send you a proposal with the final price, estimated timeline, included revisions, usage rights, and payment details.Work will only begin after you approve the proposal and complete the required payment.During the process, I may send sketches, previews, or work-in-progress updates for approval. Clear and timely feedback is important to make sure the final artwork matches the agreed request.3. Right to Refuse ServiceI reserve the right to refuse any request, commission, client, or project for any reason and without explanation.I also reserve the right to cancel or refuse future commissions in cases of disrespectful behavior, violation of these Terms of Service, misuse of my artwork, lack of communication, harassment, or any situation that makes me uncomfortable continuing the service.4. Client ResponsibilitiesThe client is responsible for providing accurate and complete information before the commission begins.Any important design details, required features, color preferences, outfit details, species, body type, personality notes, or references must be provided upfront.I am not responsible for making major changes based on information that was not provided before or during the sketch stage.The client must only provide references, characters, logos, or materials they have the right to use.5. PaymentPrices are determined individually based on complexity, deadline, usage rights, and the type of artwork requested.Accepted payment methods will be communicated at the time of the proposal.Depending on the commission, full payment or an initial payment may be required before work begins. If a remaining balance is due, it must be paid before the final unwatermarked artwork is delivered.By submitting payment, the client acknowledges and agrees that they are paying for my time, labor, artistic process, and reserved commission slot.6. Refund PolicyI do not offer refunds. All payments are final and non-refundable once made.Refunds will not be provided due to impatience, change of mind, dissatisfaction caused by ignoring the agreed process, delays within the stated turnaround time, or failure to read these Terms of Service.This policy applies to the fullest extent permitted by applicable law and the rules of the platform or payment method used.7. RevisionsThe number of included revisions will be specified in the proposal.Revisions should be requested during the appropriate stage of the process. Small adjustments are allowed during the sketch stage.Major changes after the initial sketch has been sent or approved may require an additional fee. Major changes include, but are not limited to, changing the character’s hairstyle, outfit, body type, species, pose, expression, concept, or overall design direction.Once the final artwork is completed, only minor corrections may be accepted, such as fixing small mistakes that were not present in the approved sketch.8. Timeline and Turnaround TimeMy turnaround time varies depending on my real-life commitments, health, personal circumstances, and current commission workload.I generally set a maximum timeframe of up to three months for commission completion. However, please do not commission me if you cannot tolerate long waits or flexible deadlines.Estimated timelines are not guaranteed unless explicitly agreed upon in writing. If there is a significant delay, I will do my best to communicate it as soon as possible.Delays caused by late feedback, unclear communication, or major changes requested by the client may extend the turnaround time.9. Communication and Progress UpdatesAll communication must be clear and respectful.You are welcome to ask for progress updates during the commission process. However, please do not spam, pressure, rush, or repeatedly message me for updates.Frequent rushing, spam, or disrespectful communication may result in the commission being paused, cancelled, or refusal of future service.The client is expected to respond within a reasonable timeframe when feedback or approval is needed. If the client becomes unreachable for an extended period, the commission may be paused or considered complete based on the last approved stage.10. DeliveryThe final artwork will be delivered through the agreed communication channel, such as email, download link, or platform delivery system.Final files will usually be delivered as high-resolution PNG files unless another format is agreed upon beforehand.A transparent background may be included if requested and agreed upon.Once the final artwork has been delivered and the feedback period has passed, the commission will be considered complete.11. Intellectual Property and CopyrightUnless otherwise agreed in writing, I retain the copyright and intellectual property rights to the artwork, sketches, concepts, and designs I create.Purchasing a commission does not transfer copyright ownership to the client.The client receives a usage license based on the purpose agreed upon at the time of the commission.Personal use is included by default unless stated otherwise.Commercial use, content creation use, merchandising use, redistribution, resale, or use in products must be discussed and licensed separately.The client may not claim the artwork as their own creation, resell the artwork, redistribute the files, or use the artwork beyond the agreed license.12. Usage LicensesA Personal Use License allows the client to use the artwork for non-commercial purposes, such as profile pictures, personal character references, wallpapers, personal posts, or private collections.A Content License is required if the artwork will be used for content creation, including videos, streams, social media branding, thumbnails, banners, or monetized online platforms.A Merchandising License is required if the artwork will be used on products for sale, including prints, stickers, charms, shirts, digital goods, or other merchandise.Licenses must be agreed upon before the artwork is used for commercial, content, or merchandising purposes.13. Modification of ArtworkThe final artwork may not be edited, traced, heavily altered, recolored, redrawn, or modified by the client or a third party without my permission.Minor adjustments for platform use are allowed, such as cropping, resizing, or adding a simple background, as long as the integrity of the original artwork is maintained.The client may not remove my signature or watermark from preview files.If significant changes are needed after completion, the client must contact me to discuss a paid revision or a new commission.Unauthorized modifications may result in the revocation of the usage license and refusal of future commissions.14. Artist RightsI reserve the right to display the final artwork, sketches, or process images in my portfolio, commission examples, social media, or promotional materials unless privacy has been requested and agreed upon beforehand.If the client wants the commission to remain private, this must be discussed before the commission begins. Private commissions may have an additional fee.I reserve the right to decline any request for any reason and without explanation.I also reserve the right to refuse future commissions from clients who violate these terms, behave abusively, rush me excessively, spam me, or misuse my artwork.15. Prohibited UsesThe client may not use the commissioned artwork for hateful, discriminatory, illegal, defamatory, or harmful purposes.The client may not use the artwork for NFTs, blockchain-related projects, AI training, AI datasets, or AI-generated edits unless explicitly agreed upon in writing.The client may not use the artwork in a way that falsely implies endorsement, partnership, or authorship by another person, brand, or company.16. Changes to These TermsI may update these Terms of Service at any time.The terms that apply to a commission are the terms agreed upon at the time the commission was accepted, unless both parties agree otherwise.By commissioning me, you acknowledge that you have read, understood, and agreed to these Terms of Service.If you have any questions, please contact me before submitting your request or making payment.
